Terms of Service

By downloading, installing, and using PlasticAi (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following notification of changes constitutes your acceptance of the updated Terms.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use PlasticAi. By using the App, you represent and warrant that you meet this age requirement.

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

3.2 Restrictions

You agree NOT to:

• Reverse engineer, decompile, or attempt to access the source code
• Use the App to generate images for commercial purposes without explicit permission
• Distribute, sell, or sublicense the App or its content
• Use the App in any way that violates applicable laws or infringes third-party rights
• Attempt to gain unauthorized access to the App's servers or systems
• Use the App for automated bulk processing (scraping, bots, etc.)
• Harass, abuse, or harm others using the App

4.1 Subscription Plans

PlasticAi offers subscription tiers that unlock premium features. Free tier users have limited monthly generations.

4.2 Billing

• Subscriptions are billed through Apple In-App Purchases on iOS and Google Play Billing on Android
• You will be charged according to the plan you select
• Charges appear on your Apple account statement (iOS) or Google Play account statement (Android)
• We do not directly handle payment processing — this is managed by Apple or Google

4.3 Renewal

• Subscriptions automatically renew at the end of each billing period
• You will be notified before renewal charges are applied
• To manage or cancel your subscription: on iOS, visit Settings > [Your Name] > Subscriptions; on Android, open the Google Play Store > Menu > Subscriptions

4.4 Cancellation

• You may cancel your subscription at any time through your device's app store settings (Apple ID subscriptions on iOS, or Google Play subscriptions on Android)
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial months or unused content
• Cancellation does not delete the data stored on your device — your photos and results remain on your device until you remove them

4.5 Price Changes

• We may adjust subscription prices with 30 days' notice
• Existing subscribers will be notified of price increases
• Continued use after the increase constitutes acceptance of the new price

5.1 Disclaimer

PlasticAi uses artificial intelligence (powered by Google and Anthropic) to generate cosmetic procedure previews. These previews are:

• Simulations and artistic interpretations, not medical predictions
• NOT substitutes for professional medical consultation
• Approximations based on AI training data, not guaranteed to reflect actual surgical results
• Generated for entertainment and educational purposes only

5.2 Accuracy

While we strive for realistic previews, AI-generated images may not perfectly represent actual cosmetic procedures. Results vary based on:

• Individual anatomy and skin characteristics
• Surgeon skill and technique
• Lighting, angles, and photography conditions
• Post-procedure healing and natural results

DO NOT rely on PlasticAi previews as the sole basis for cosmetic surgery decisions. Always consult with a licensed medical professional.

5.3 Your Generated Images

• You own the rights to images you generate for personal use
• You may download, save, and share generated images
• You may NOT use generated images for commercial purposes, misleading advertising, or impersonation without explicit permission

6.1 Your Responsibility

You represent and warrant that:

• You own or have permission to use all photos you upload
• Photos do not violate anyone's privacy or intellectual property rights
• You have the right to process those photos through AI services

6.2 Our Use of Your Photos

• We use your photos only to generate previews and your facial analysis report for your personal use
• Your photos are stored only on your device, not on our servers, and remain until you delete them (see Privacy Policy)
• We do not use your photos to train AI models
• We do not share your photos with third parties except the AI providers necessary to generate your results

6.3 Prohibited Content

Do not upload photos that contain:

• Minors (under 18)
• Other people without their consent
• Copyrighted or trademarked content
• Hateful, violent, or illegal content

Violation may result in account suspension or termination.

7.1 App and Services

All content within the App — including text, graphics, logos, features, and functionality — is the property of PlasticAi or our licensors. You may not copy, modify, or distribute this content without permission.

7.2 Third-Party Content

The App uses AI services from Google and Anthropic. Their intellectual property rights are governed by their respective terms of service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PlasticAi is provided "AS IS" without warranties of any kind
• We do not warrant that the App will be error-free, uninterrupted, or meet your expectations
• We are NOT liable for:
  • Inaccurate or unrealistic AI-generated previews
  • Decisions made based on PlasticAi previews
  • Loss or corruption of photos or data
  • Indirect, incidental, consequential, or punitive damages
  • Business losses or lost profits

The maximum liability of PlasticAi shall not exceed the amount you paid for your subscription in the past 12 months.

You agree to indemnify and hold harmless PlasticAi, its creators, and partners from any claims, damages, or costs (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your infringement of third-party rights
• Content you upload or generate using the App

PlasticAi is NOT a medical service and does not provide medical advice. Generated previews are not:

• Clinical assessments
• Surgical predictions
• Medical diagnoses
• Professional cosmetic recommendations

Always consult with a licensed plastic surgeon or dermatologist before pursuing any cosmetic procedure.

PlasticAi accepts no responsibility for medical decisions made based on previews generated by our App.

We may terminate or suspend your access to the App immediately if you:

• Violate these Terms
• Upload prohibited content
• Use the App for fraudulent or illegal purposes
• Repeatedly breach our usage policies

Upon termination, your license to use the App is revoked. Your data remains on your device and you can delete it at any time per our Privacy Policy.

The App may contain links to third-party websites (e.g., surgeon databases, educational resources). We are not responsible for:

• Content on external websites
• Third-party privacy practices
• Third-party terms of service

Your use of external links is at your own risk.

13.1 No Medical Warranty

We make no claims that PlasticAi previews will match actual surgical results. Every person's anatomy is unique. Cosmetic surgery outcomes depend on factors we cannot predict.

13.2 No Professional Endorsement

PlasticAi does not endorse or recommend specific surgeons, procedures, or clinics. Any mentioned professionals or services are for informational purposes only.

13.3 Third-Party AI Services

PlasticAi relies on third-party AI services (Google, Anthropic). We are not responsible for:

• Service outages or delays
• Inaccuracies in AI-generated content
• Changes to third-party terms or pricing
• Third-party data practices (see their Privacy Policies)

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.

Any legal action arising from these Terms must be brought in the courts of the United Kingdom. You consent to the jurisdiction and venue of these courts.

In the event of a dispute, we encourage you to contact us first at support@visageai.app to attempt resolution.

If informal resolution fails, disputes may be resolved through:

• Binding arbitration
• Small claims court (if applicable)
• Litigation in courts of the United Kingdom

If any provision of these Terms is found to be invalid or unenforceable, that provision will be removed, and the remaining Terms will remain in effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlasticAi regarding the App. Any prior agreements, understandings, or negotiations are superseded by these Terms.
